A car accident in Beckley on Monday was caused by a suspected drunk driver. According to the Beckley newspaper, a suspected drunk driver pulled out directly in front of another vehicle in front of the Little General on Eisenhower Drive around 2 p.m. The suspected DUI driver was arrested. Charleston WV Rape Lawsuit Settles

Our office represented a 13-year old victim of multiple sexual assaults and rapes that occurred at a high profile location near Charleston, West Virginia. The incidents happened inside of what was supposed to be a highly secured area where minor children were not allowed according to state regulations. Each time that the minor child was taken to the area, the criminal perpetrator had to go through a security checkpoint where the security guard should have stopped the vehicle and/or prevented the minor from entering.

Rist Law Offices filed a civil lawsuit on behalf of the victim against the entity that owned the secure area, the business that hired the criminal perpetrator, a state agency that was supposed to regulate security, and the criminal perpetrator. All of these entities denied any liability and even maintained that security was appropriate in the area where the sexual assaults occurred. Yet during the deposition of the security director of the business, it was disclosed that parties were happening inside of this secure area and that employees of various businesses had broken items and left empty liquor bottles and beer cans in the area.

The case settled for a confidential amount during a 12-hour long mediation. Following settlement, one of the defense lawyers involved in the case commended our office for representing the victim and stated that we “did an outstanding job helping the young girl to recover from a tragic series of events.”

Charleston WV Sniper Suspect Arrested

Charleston Police report that an arrest was made in a case arising out of an August 2003 sniper shooting. According to the Charleston Gazette, Shawn Lester of Charleston was arrested and charged with first and second degree murder. The story is located here.

Charleston Man Robbed at Knifepoint

A Charleston, West Virginia man was robbed at knifepoint late last week while walking his dog near Charleston Arbor Apartments at 100 Washington Street, East. According to this Charleston Gazette article, the man was robbed by two men who were demanding money. The victim received minor injuries to his neck and was treated at the scene by paramedics.

Woman Found Dead in Front of West Side Bar

Beverly Ann Simley of Charleston was found shot dead outside of The Bird House Cafe and Lounge on Sixth Avenue in Charleston’s West Side early Tuesday morning. According to an article in the Charleston Gazette, Ms. Simley was a bartender at the business and was well liked by neighbors and area business owners.

Police reported that Ms. Simley sustained at least one gunshot wound and was found in her car outside of the bar by a bus driver around 4:30 in the morning. Police are asking for anyone with information to call (304) 348-6480.

Man Stabbed in Charleston’s East End

A man was hospitalized after being stabbed in Charleston’s East End yesterday. According to an article in the Charleston Gazette, 911 was called after the man walked up to a house at 1500 Lee Street East with an apparent stab wound.
